Took over conduct of case after client's deportation appeal had been dismissed. Identified that the client was exempt from deportation altogether which had been missed by previous representatives and the FTT judge!
Permission was granted by the UT and at the further hearing the UT judges questioned whether the client retained his exemption given Pakistan had left the Commonwealth in 1972 and it was a necessary requirement that the client was a Commonwealth citizen as of 1 January 1973. Further research showed that the Pakistan Act 1973 extended Pakistan's membership until after that date and the exemption was retained. Remarkable result for the client who was about to have his entire life taken away from him. He has been resident in the UK since 1971 when he was aged just 5. the client's profound comment was 'you have just saved my life'
