Client's leave was cancelled based on an allegation that he obtained his leave by deception, which he vehemently denied.
Lodged a Human Rights claim for the client and then lodged his appeal with the Tribunal who refused jurisdiction. A judicial Review was commenced challenging the Tribunal's refusal to accept jurisdiction. The SSHD later refused the Human Rights claim and certified that claim thereby excluding a right of appeal on that basis too. Eventually following an appeal to the Court of Appeal the SSHD conceded the matter by agreeing to reconsider the claim but proceeded to refuse the claim with an in country right of appeal. The client's appeal was allowed on the spot by the FTT judge who had no hesitation in accepting that the client had not engaged in any deception. Client was forced to fight a marathon 4 year battle to prove he was right all along!
