Indefinite Leave to Remain reinstated after successful JR and appeal.
Our client's indefinite leave to remain as a spouse of British national was cancelled due to his failure to disclose an overseas conviction prior to his arrival in the UK in 2002. The UKBA asserted that he had no right of appeal against this decision and the Immigration Tribunal refused to consider his appeal. We successfully judicially reviewed the Tribunal's refusal to consider his appeal. Subsequently the Tribunal allowed his appeal accepting that there had been no material deception in obtaining his visa in the first instance and his indefinite leave was reinstated. We are now pursuing an unlawful detention claim on his behalf.
