The SSHD certified the client's Human Rights claim following cancellation of his leave for allegedly obtaining his language certificate by deception.
This case involved a number of complex arguments about whether the client had an in-country right of appeal based on the technicalities of the 'Nirula' point. The SSHD also separately certified the client's human rights claim based on his alleged deception in obtaining a Toeic language certificate by proxy. Both decision were challenged by JR and the case proceeded to the Court of Appeal. The SSHD eventually conceded the claim and will now make a fresh decision.
