We acted for a British child born in Pakistan who's father refused to assist in securing a British passport for him and refused to provide documentation to assist with his application either.
We acted for a British child born in pakistan who's father refused to assist in securing a British passport for him and refused to provide documentation to assist with his application also. The child's birth had not been registered contemporaneoulsy and issues were likely to arise regarding the relationship with the British father. As a result we assisted the child in making an application for a declaration of paternity in the County Court and then relied on that as conclusive proof of the relationship.
Having secured the declaration of paternity we advised the child to apply for a certificate of entitlement to the right of abode (COE) to confirm his status as a British citizen rather than a British Passport. the sole reason for this being that there is a full right of appeal against refusal of a COE. There are no rights of Appeal against any decision to refuse a British Passport. The child was successful and is now finally able to enjoy his rights as a British Citizen. He was aged 20 when he first arrived in the UK.
